These are the terms of service (the “Terms”) of Podspace that are applicable to you once you register an account on Podspace’s website and consequently, enter an agreement with Podspace AB (556991-4046).
Please see our privacy policy for more information on how we gather data through the Service. The privacy policy forms an integral part of the Terms.
Once your account has been registered, and these Terms have been approved, you will be given access to Podspace’s platform (the “Platform”) where you will have the option to purchase an access to any of the, at the time, offered products and/or services (the “Content”) within the Platform (“the Service). All Content is created and owned by third parties which means each Content may be subject to different conditions and prices. The Content is purchased within the Platform but it is consumed on the third party listening service where it is made available for listening. The Service may be subject to changes leading to the Platform, the Content, features and functions being added or removed.
To register an account (the “Account”), you ensure that you are 18 years old or older, have legal capacity and are not acting on behalf of a legal entity. Your username and password are for personal use only and must be kept confidential. You understand that you are responsible for all use (including unauthorized use) of your username and password. You undertake to inform Podspace of any unauthorized activities, or loss of login credentials, connected to the Account.
Once the Account is opened and these Terms have been accepted, Podspace grants you a non-exclusive, non-transferable and non-sublicensable right to access and use the Platform and purchased Content in accordance with the Terms and during the term of your agreement with Podspace in accordance with clause 12.
Having an Account is free of charge. The fee and payment terms of the Content, and other specific conditions are stated on the Platform and presented before making the payment to Podspace. The purchase is completed once Podspace has confirmed your purchase. Podspace may unilaterally limit or reject a certain purchase of Content. Such limitation or rejection may, for example, be due to the number of purchased units of the Content being higher than what is reasonable for one user.
The fee of any purchased Content is to be paid in advance and may be a one-time payment, be recurring monthly, quarterly, yearly or as otherwise specifically stated and described. Recurring payments (subscriptions) is withdrawn from your registered credit card (or other applicable payment method) in advance and upon the renewal date of the subscription.
The Platform is provided “as is” without warranties of any kind and Podspace does not guarantee its uninterrupted, secure, or error-free operation. For the avoidance of doubt, the Content is solely purchased through the Platform and any fault or deficiency related the consumption of the Content shall be directed to the third party providing the listening service. Consequently, Podspace cannot guarantee the availability of consumption of the Content since this is provided by third party listening services.
Since Podspace want to continuously improve and develop the Service, Podspace reserves the right to modify, suspend, and/or discontinue properties of the Service, including purchased Content, at any time without liability and without obtaining your consent. All new functionalities, features and Content introduced to the Service will be subject to these Terms.
You acknowledge that Podspace is not responsible for the accuracy of the Content and that reliance on such Content is expressly at your own risk. Podspace shall have no liability for direct or consequential loss arising as a result of the accuracy, timeliness, completeness or usefulness of information available through the Content.
The Content may include material from or links to third party websites not controlled by Podspace. Podspace are not responsible for the accuracy of any such content. Third party services may be subject to their own terms and conditions. Any arrangement made between you and any third party named on the Platform is at your sole risk and responsibility. The Service may contain advertisement from third parties. You acknowledge and agree that advertisement is a part of the Service that we provide to you.
Podspace’s support regarding the Service is available 10.00-16.00 (CET) during workdays, except for Swedish public holidays, and Podspace’s aim is to attend any support matter during the following workday from receival. Please note that support regarding the functionality or availability of the consumption of the Content is not provided by Podspace since the this is not included the Service.
